FEES:

Charge Legal Aid Rates of $120.00 per hour plus disbursements and HST

Here are some examples of the fees you might expect for certain services:

These are minimum fees that experience has indicated will be pretty close if the party we are acting for provides our office with the required and requested information to complete these documents in a timely fashion.

Above rates are subject to additional disbursements and HST costs and you will be advised of such costs during initial consultation.

Other Services

All other services are at the hourly rate of $120.00.

Complicated matters, large number of documents to be reviewed and/or anything else that may result in additional time to prepare any document over and above that set out above, the additional time shall be calculated at hourly rate.

 

Client’s Responsibilities

It is the client’s responsibility to serve any document prepared, although if requested, we can assist with service through a process service company and the client will be required to contract and pay for such services directly with the Process Service.

It is the client’s responsibility to file any document prepared with the Court, although if requested we can assist with filing with the Court through a filing service company and the client will be required to contract and pay for such services directly with the Filing Service.

It is the client’s sole responsibility to ensure all Court deadlines are met.  This can be easily accomplished by retaining our services in a timely manner, providing our office with all required and requested information as soon as possible, and by doing everything possible to meet the Court schedules for filing.

 

Prior to Commencement of Any Work

Prior to any work being commenced on your behalf, you will be required to attend a consultation appointment.  At that time, you will meet with the lawyer to determine the issues of your case, recommend a course of action based upon the information provided, and determine the services and costs of such services you wish this office be provided to you.  Prior to attending the appointment, you will be required to download from our website information forms and questionnaires to be completed and returned to our office.  You will be required to bring the signed originals to your appointment.  If you are unable to download the necessary documentation from our website, you will need to attend our offices in Niagara Falls and pick up the necessary materials and return to our office well in advance of your appointment.  If you fail to do so your appointment will either be rescheduled or cancelled without rescheduling.

Any materials you wish the lawyer to review in regard to your matter must be provided prior to the appointment either by bringing the materials to the office or uploading the documents to the website.  You will be charged at the hourly rate in 1/10th of an hour increments to review any materials.  Unless time permits, no materials will be reviewed at the consultations.

 

NO REPRESENTATION

At no time is our office and/or Brian C. Wilcox representing you in your Court action and at no time shall you represent to the Court that Brian C. Wilcox is representing you in your Court action either to the Court, the Court staff, the other party(is) or or their legal counsel; duty counsel or any other person whatsoever.  If a client does so, no further services shall be provided to that client by this office, ever!
